The Digital Asset Market Clarity (CLARITY) Act, a proposed legislation to structure the U.S. virtual asset market, is facing hurdles in the Senate due to partisan disagreement over ethical provisions governing conflicts of interest for federal officials in relation to virtual assets.

According to reports on Wednesday, the Democratic Party maintains that State Attorneys General should be granted the authority to enforce ethical provisions regulating conflicts of interest for federal officials regarding virtual assets. On the other hand, the White House and the Republican Party argue that this authority should be vested in the U.S. Attorney General.

The contentious ethical provision aims to restrict high-ranking government officials, including the President, Vice President, and members of Congress, from engaging in virtual asset businesses. Democrats argue that since the federal Department of Justice operates under presidential influence, State Attorneys General should exercise this authority to ensure independent enforcement.

President Donald Trump previously stated his willingness to accept the most comprehensive ethical provisions in history, but specific details have not yet been shared with the Democrats. Concerns over conflicts of interest persist, particularly as Trump and his family are involved in virtual asset businesses such as World Liberty Financial.

The legislative timeline is tight. Industry insiders anticipate Senate floor consideration as early as next week, but if negotiations over the ethical provisions remain unresolved, a vote could be delayed. With the Senate scheduled to begin its summer recess on August 7, the fate of this year’s legislation hinges on whether it can be processed before the break.

Even if the Senate passes the bill, the process is far from over. The House will need to vote again on the Senate’s amendments. Additionally, internal disagreements within the Republican Party and demands for further modifications from some Democratic representatives suggest that the path to final legislation will likely be fraught with challenges.
