On Thursday, CNBC reported that federal prosecutors in the Southern District of New York have indicted an executive from a U.S. information technology (IT) company for allegedly smuggling billions of dollars worth of Nvidia’s artificial intelligence (AI) chips to China.

The prosecutors arrested and charged the executive, who is associated with an American server manufacturer, for allegedly orchestrating the unauthorized export of a substantial quantity of AI chips to China.

The investigation is centered on uncovering how Nvidia’s specialized AI chips were exported to China without proper authorization.

With U.S. AI companies like OpenAI and Anthropic facing increasing competition from China’s DeepSeek, prosecutors view this smuggling operation as a critical national security issue and are dedicating significant resources to the investigation.

In August of last year, Nvidia secured an export license to sell to China, agreeing to pay 15% of its profits to the U.S. government. More recently, the Chinese government approved the import of Nvidia’s H200 chips, which were specifically designed for the Chinese market.
